S. 5648 — TAG Act

This section defines terms used in the Act, including agency, artificial intelligence, automated system, critical decision, human-like service, personally identifiable information, plain language, prompt, substantially influence, timely, and transparent automated government guidance.

This section directs the Director to issue a directive within 90 days after enactment requiring each agency to publish, by 180 days after enactment, a public inventory of all augmented critical decision processes using artificial intelligence (including contracts and vendors) and all critical decisions subject to the Act, and to issue biannual public notifications while related guidance is finalized. It further requires the Director to issue guidance on protecting privacy, civil rights, and civil liberties in such processes; identifying critical decisions; providing plain-language notice, appeals processes with time limits and tracking, and human review alternatives; tracking accuracy and fairness metrics with data protocols; and soliciting and responding to public input. It also requires guidance on appropriate and inappropriate uses of chatbots and similar technologies for public interactions.

This section requires the Director to issue a preliminary version of the transparent automated government guidance for public comment within 180 days of enactment. It directs each agency head to implement the guidance or any subsequent update within 180 days of issuance. It also requires the Comptroller General to review agency compliance and submit findings and recommendations to the Senate Committee on Homeland Security and Governmental Affairs and the House Committee on Oversight and Government Reform every 2 years beginning 2 years after enactment.
