This section prohibits gratuities to agents of organizations, state, local, or tribal governments, or their agencies that receive more than $10,000 in federal benefits in any one-year period. It creates a new offense, punishable by a fine, up to 2 years in prison, or both, for an agent to solicit, accept, or agree to accept anything of value intending to be rewarded (or for any person to give, offer, or agree to give anything of value to reward an agent) in connection with any business, transaction, or series of transactions valued at $5,000 or more, separate from the existing 10-year penalty for bribery involving intent to influence. It also updates the section heading to “Theft, bribery, or gratuities concerning programs receiving Federal funds.”
