This section establishes a new nonimmigrant visa category for aliens sponsored by a state to temporarily reside in that state to perform services, provide capital investment, direct the operations of an enterprise, or otherwise contribute to the state's economic development agenda as determined by the state, along with their spouses and minor children.
This section establishes a State-sponsored nonimmigrant program under which states may sponsor aliens for admission as nonimmigrants in a new W classification. Participating states must regulate the employment and residence of such nonimmigrants, assess labor needs and wage data, investigate complaints of U.S. worker displacement, attest that the hiring does not displace U.S. workers, and report annually on participants’ locations and employment. Aliens must pass National Vetting Center background checks, pay any required state bond, and reside and work only in the sponsoring state (or compact states). Authorized status lasts up to 3 years and is renewable only if the state requests it and the nonimmigrant has resided continuously in the sponsoring state.
This section directs the Secretary of Homeland Security, in consultation with the Secretary of Labor and the Attorney General, to issue regulations within 180 days of enactment implementing the State-sponsored nonimmigrant program under section 214(s) of the Immigration and Nationality Act.
