S. 5092 — RAAM Act

This section repeals the corporate average fuel economy (CAFE) standards program under chapter 329 of title 49, United States Code, for all manufacturers beginning with model year 2029. It updates the definition of "consumer product" in 42 U.S.C. 6291 to remove the prior cross-reference to the title 49 automobile definition and inserts a standalone definition of "automobile" limited to 4-wheeled vehicles under 10,000 pounds gross vehicle weight, excluding rail vehicles, certain multi-stage vehicles, and work trucks.

This section reserves exclusive federal authority under the Commerce Clause to set fuel economy standards for motor vehicles manufactured for sale in interstate commerce. It prohibits states and localities from adopting or enforcing any law or regulation requiring compliance with fuel economy or average fuel economy standards, and affirms a right for manufacturers, distributors, sellers, and consumers to be free from inconsistent state requirements.
