S. 5044 — Honoring the Victims of Communist China’s Tyranny Act

This section defines terms used throughout the Act: the International Park as the public park and landscaped area in Northwest Washington, D.C., near 3505 International Place NW and bounded by International Place NW and International Drive NW; the memorial as the one established under section 3; and the Secretary as the Secretary of State.

This section directs the Secretary to establish a memorial in International Park within 2 years of enactment. The memorial honors victims of genocide and crimes against humanity by the Chinese Communist Party, especially under Xi Jinping, and individuals persecuted for exercising political and religious rights in the People’s Republic of China; it must include messages of U.S. solidarity and friendship with the Chinese people and educational elements on the Uyghur genocide, suppression of Tibetan and Southern Mongolian culture, imprisonment of figures such as Jimmy Lai, and broader restrictions on freedoms, while leaving existing memorials in the park unchanged.

This section directs the Secretary to administer the memorial and authorizes consultation with survivors of persecution, genocide, imprisonment, or political repression in the People’s Republic of China—especially those persecuted during Xi Jinping’s tenure as General Secretary of the Chinese Communist Party—their family members, and organizations promoting democracy, human rights, ethnic and religious freedom, or freedom of expression in China.

This section authorizes the Secretary of State to use existing Department of State appropriations, including from the Bureau of Administration, to establish, maintain, preserve, and improve a memorial. It caps federal expenditures for design and construction at $500,000 while permitting unlimited private donations for those purposes and barring any additional appropriations.
