“A bill to amend the Federal Water Pollution Control Act to modify allotments under that Act, and for other purposes.”
No CRS summary available for this bill.
This section revises the allotment formula for grants to states under section 205 of the Federal Water Pollution Control Act. It sets aside 0.1 percent of annual appropriations for Buy American oversight, 2 percent for Indian tribes, and 1.5 percent for United States territories (consistent with fiscal year 2026 levels). It then allots the remainder to the 50 states, the District of Columbia, and Puerto Rico using a weighted formula of 60 percent based on needs identified in the most recent clean watersheds needs survey, 20 percent based on total population, and 20 percent based on population at or below 200 percent of the federal poverty level. The section caps annual increases at 200 percent and decreases at 25 percent during a four-year transition period and requires annual publication of updated allotments. It updates the minimum allotment provision for fiscal year 2027 and later years and confirms that the changes do not affect amounts provided under the Infrastructure Investment and Jobs Act.
This section terminates the requirement that the Environmental Protection Agency prepare a detailed biennial estimate of the nationwide cost of constructing all needed publicly owned treatment works, a comprehensive study of the economic impact of those costs on units of government, and a comprehensive analysis of national requirements for municipal wastewater treatment.
This section authorizes each state to use not more than 0.5 percent of amounts received through a capitalization grant under title VI and section 205(m) of the Federal Water Pollution Control Act each fiscal year to carry out activities necessary for the clean watersheds needs assessment under section 609. It also designates the existing technical assistance authority as paragraph (1).
