This section directs the Judicial Conference of the United States to establish rules within 180 days imposing conditions on district court appointments of monitors to oversee state or local government conduct. The rules limit monitors to one monitorship at a time and a maximum 5-year term with no reappointment under the same order, bar subsequent monitors from the prior monitor’s employer, cap fees at Judicial Conference rates while permitting pro bono or reduced-rate work, require public notice and comment before appointment, mandate annual public accountings of services and fees, transfer cases to a new judge after 6 years, and apply these limits retroactively to monitorships already in effect for 6 years on the date of enactment.
