S. 4882 — ICTS Supply Chain Security Act of 2026

This section establishes the position of Assistant Secretary of Commerce for Information and Communications Technology Supply Chains, appointed by the President with Senate confirmation and reporting to the Under Secretary of Commerce for Industry and Security. The Assistant Secretary oversees the Office of Information and Communications Technology and Services. It also retitles Part III of the Export Control Reform Act of 2018 as “Organization of Bureau of Industry and Security.”

This section establishes an Office of Information and Communications Technology and Services within the Bureau of Industry and Security to administer part IV of the Export Control Reform Act of 2018 and carry out other duties assigned by the Secretary or the Assistant Secretary of Commerce for Information and Communications Technology Supply Chains. The head of the Office reports directly to that Assistant Secretary. It requires the Office to provide any information obtained in carrying out its duties to the appropriate congressional committees upon request by the chairman or ranking minority member, subject to confidentiality protections.

This section prohibits any acquisition, importation, transfer, installation, dealing in, or use of information and communications technology or services (ICTS) by persons subject to U.S. jurisdiction if the transaction involves ICTS designed, developed, manufactured, or supplied by persons from a country of concern—China (including Hong Kong and Macau), Cuba, Iran, North Korea, or Russia—and the Secretary of Commerce determines it poses an undue risk of sabotage, catastrophic effects on U.S. critical infrastructure or the digital economy, or other unacceptable national security risks. It exempts expressive materials and open-source software, authorizes the Secretary to issue regulations establishing mitigation measures, categorical exclusions, licensing procedures, and other requirements, and assigns administration to the Office of Information and Communications Technology and Services.
