S. 4774 — Fraudulent Artificial Intelligence Regulations (FAIR) Elections Act of 2026

This section prohibits the knowing distribution of false AI-generated election media that contains materially false information about the time, place, or manner of federal elections or voter eligibility, when done with the purpose of impeding voting, or that falsely depicts an election official, when done with intent to intimidate or harass the official or deter voting. It exempts certain news broadcasts and publications that disclose the falsity and authorizes the Attorney General to seek civil declaratory and injunctive relief.

This section prohibits states from removing any voter from official registration lists for Federal elections or acting on eligibility challenges unless the determination relies on source information from governmental entities obtained through official duties or data approved by the Attorney General. Approved data must include qualifying sets such as full name plus Social Security number, be updated monthly, and comply with the Computer Fraud and Abuse Act.

This section prohibits the Federal Government from comparing any federal information about an individual with state or local government information to determine eligibility to vote in federal elections. It authorizes any aggrieved person to sue in district court for declaratory or injunctive relief.

This section directs the Comptroller General to study the effects of using Federal databases, including the Systematic Alien Verification for Entitlements (SAVE) system, to remove individuals from official voter lists for Federal elections. The study must examine potential suppression of voting rights, the accuracy of eligibility determinations, and the number of erroneous removals in each State, with a report due to the Senate Committee on Rules and Administration and the House Committee on House Administration within 180 days of enactment.

This section provides that if any provision of the Act or an amendment made by the Act is held invalid, the remainder of the Act and its amendments remain in effect.
