No CRS summary available for this bill.
This section establishes a federal civil right of action allowing an individual 18 years of age or older, or a legal guardian on behalf of a minor, incompetent, or incapacitated recipient, to sue a sender who knowingly transmits an intimate visual depiction—including an intimate digital forgery—without consent in interstate or foreign commerce. Plaintiffs may obtain statutory damages of up to $1,000 or compensatory damages for emotional distress, reasonable attorney fees and costs, and injunctive relief. The section permits minors to proceed under initials or a pseudonym, exempts good-faith medical, educational, or law enforcement transmissions, and preserves existing criminal law and First Amendment protections.
