S. 3530 — Strategic Resources Non-discrimination Act

This section amends the Defense Production Act of 1950 (DPA) by (1) limiting the President's authority under DPA Section 101(c) to allocate materials, equipment, and services or require priority contract performance to maximize domestic energy supplies by prohibiting such use for environmental protection purposes; and (2) prohibiting denial of financial support (i.e., loans, purchases, or guarantees) under DPA Title III §§301-303, other than for energy production, based on a person's engagement in the exploration, development, production, utilization, transportation, or sale of fossil fuel-based energy. (Title III authorizes the President to provide such incentives to expand U.S. productive capacity and supplies essential to national defense.)
