H.R. 9940 — Disability Community Act of 2026

This section increases the federal medical assistance percentage to 90 percent for Medicaid expenditures in 2027, 2028, or 2029 for items and services in intermediate care facilities for individuals with intellectual and developmental disabilities or for home and community-based services for such individuals, as determined by the Secretary to be attributable to compliance with specified regulations in 29 CFR part 541.600 or 42 CFR parts 430–447. It updates terminology throughout Title XIX by replacing references to “mentally retarded” and “mental retardation” with “individuals with intellectual and developmental disabilities” and “intellectual or developmental disability.”
