H.R. 9919 — Ban Birth Tourism Act of 2026

This section makes inadmissible any alien seeking admission as a B nonimmigrant for the primary purpose of obtaining United States citizenship for a child by giving birth in the United States. It also renders inadmissible aliens likely to give birth within 10 months of entry, based on the reasonable judgment of the Secretary of Homeland Security, the Secretary of State, or a consular officer.

This section makes an alien deportable for birth tourism. An alien is deportable if the Secretary of Homeland Security, the Secretary of State, or a consular officer determines that the alien entered or reentered the United States primarily to obtain United States citizenship for a child by giving birth in the United States or its territories, or is likely to give birth within 10 months of entry and thereby obtain citizenship for the child based on birth on United States soil.
