No CRS summary available for this bill.
This section defines terms used throughout the Act, including “antitrust laws,” “artificial intelligence,” “assistance,” “covered artificial intelligence security purpose,” “covered artificial intelligence security risk,” “exclusive purpose,” “non-Federal entity,” and “unauthorized access” with respect to artificial intelligence.
This section exempts from the antitrust laws agreements between two or more non-Federal entities to share information or assistance on covered artificial intelligence security risks, or to coordinate delays or limits on the release, deployment, development, training, testing, or evaluation of artificial intelligence, when undertaken exclusively for security purposes and after written notice to the Assistant Attorney General detailing the risk and scope of the restriction. It requires recipients to use the information only for those purposes and maintain internal controls, bars price-fixing and market allocation, preserves private rights of action for non-exempt conduct, and exempts the notices from disclosure under FOIA.
This section authorizes the Attorney General to seek injunctions in federal court against non-Federal entities to halt actions that violate antitrust laws in connection with covered artificial intelligence security purposes. It denies any immunity or exemption from such relief if the entities fail to satisfy the burden of proof under section 3(c) or if the actions are reasonably likely to increase overall artificial intelligence security risks.
