This section transfers to the Secretary of the Interior all personnel, assets, liabilities, contracts, property, records, and unexpended balances of appropriations connected to functions transferred under the Act. Unexpended funds must be used only for their originally authorized and appropriated purposes.
This section directs the Director of the Office of Management and Budget to ensure the Act produces no net increase in full-time equivalent employees at impacted federal agencies, measured from the date of enactment. It authorizes the Director to determine transferred functions and make incidental dispositions of personnel, assets, liabilities, grants, contracts, property, records, and funds, to terminate affairs of entities ended by the Act, and to certify compliance with these requirements to the House Committee on Education and Workforce and the Senate Committee on Health, Education, Labor, and Pensions on the effective date.
This section authorizes the Secretary of the Interior to delegate transferred functions to designated officers and employees of the Department of the Interior and to permit successive redelegations, except where prohibited by law or this Act. It provides that no such delegation relieves the Secretary of responsibility for administering the functions.
This section deems references to the Secretary of Education and the Department of Education to refer instead to the Secretary of the Interior and the Department of the Interior for functions transferred under section 2.
This section preserves the validity of all orders, determinations, rules, regulations, permits, grants, loans, contracts, agreements, certificates, licenses, and privileges issued before the transfer of functions from the Department of Education to the Department of the Interior. This section authorizes the Secretary of the Interior, beginning on the date of enactment, to use Department of Education personnel, assets, and appropriated funds for functions transferred under this Act, for the period reasonably needed to facilitate orderly implementation.
This section directs the Secretary of Education to consult and coordinate with Indian Tribes on the Act's provisions within 6 months of enactment, in accordance with Executive Orders 13175 and 13592. It also requires the Secretary to provide written responses to tribal correspondence and publish those responses on the Department's public website.
This section delays the effective date of the Act and its amendments until 1 year after the Secretary of Education publishes the written response required under section 10(b). It permits transfers of functions under section 2 and other provisions to begin on the publication date and continue through the effective date.
