This section permits providers of electronic communication services to disclose communications and customer records to the Secretary of Commerce, or a designated officer or agent, when necessary to comply with regulations under the Export Control Reform Act of 2018 regarding use of covered cloud products by specified foreign entities. It defines an AI model as one trained on broad data with at least 1,000,000,000 parameters; a covered cloud product as infrastructure, platform, or software as a service used to develop or deploy such a model with a covered integrated circuit; and a covered integrated circuit by specific performance thresholds and Export Control Classification Numbers.
