This section prohibits covered entities and their business associates from disclosing pregnancy termination or loss information in any federal, state, local, or tribal proceeding without the individual’s valid authorization, with exceptions for professional liability defense and investigations of physical harm when the individual cannot consent due to death or incapacity. It directs the Secretary of Health and Human Services to revise regulations so that compliance is not treated as information blocking, health IT developers must segregate such data, and no regulatory preemption exceptions apply other than those allowing stronger state protections. It also requires an outreach campaign and publication of an interim final rule within 90 days and a final rule within 270 days thereafter.
