This section states findings that, since February 2022, Russian state and non-state actors have systematically abducted and forcibly transferred thousands of Ukrainian children to Russia or Russian-controlled areas in a pattern constituting a severe form of trafficking in persons. It further finds that these operations involve transnational organized crime, aim to erase Ukrainian identity, constitute war crimes, generate financial benefits for participants, and facilitate sex trafficking of displaced persons.
This section expresses the sense of Congress that the systematic abduction and forcible transfer of Ukrainian children by the Russian Federation constitutes one of the most egregious ongoing human-trafficking crimes of the 21st century and requires an immediate, aggressive, and coordinated sanctions response.
This section requires the President to apply sanctions under Executive Order 13581 and section 111 of the Trafficking Victims Protection Act of 2000 to persons determined to have participated in or facilitated the transfer, deportation, indoctrination, or re-education of Ukrainian children. Covered persons include Russian federal ministries, rehabilitation or patriotic education camps, Russian Orthodox Church entities, private adoption agencies operating in occupied Ukrainian territory, and any persons that benefit from or support such activities. It directs submission of an interim unclassified list of covered persons within 120 days of enactment and requires the President to determine within 120 days whether a person meets the criteria upon request from the chair or ranking member of the House Foreign Affairs, House Financial Services, Senate Foreign Relations, or Senate Banking committees.
