H.R. 9368 — Voter ID Act

This section requires voters to present valid photo identification to cast a ballot in federal elections. In-person voters must show a state-issued driver’s license, state ID, U.S. passport, Department of Defense or Veterans Affairs photo ID, or tribal photo ID with an expiration date; those without ID may cast a provisional ballot and cure it within three days by presenting ID or submitting a religious-objection affidavit. Mail and absentee voters must submit a copy of valid photo ID, the last four digits of their Social Security number plus an inability-to-obtain affidavit, or a notarized ballot, with exceptions for absent uniformed services voters and certain elderly or handicapped voters. States must provide free public access to digital imaging devices at government buildings and notify applicants of the requirements at registration, including online.

This section establishes a grant program under which the Election Assistance Commission awards funds to States and Tribal governments to issue photo identification without charge. States must provide motor vehicle driver’s licenses or state-issued identification cards that include a photo and expiration date; Tribal governments must provide identification documents that include a photo and expiration date. Eligible recipients are individuals who attest under penalty of perjury that they cannot afford the fee.
