H.R. 9330 — Earned Wage Access Consumer Protection Act

This section requires earned wage access providers to offer consumers a no-cost option for receiving earned wages if a fee-based option is available, initiate transfers within one business day, and provide specified disclosures on access limits, fees, tips, and material term changes with at least 30 days’ notice. It also mandates consumer attestations against duplicate requests in the same pay period, allows cancellation without penalty, and requires policies to address disputes over unauthorized disbursements.

This section designates the Earned Wage Access Consumer Protection Act as a federal consumer financial law. It adds providing earned wage access services to the definition of consumer financial product or service. It also excludes earned wage access services from the definition of credit and earned wage access providers from the definition of creditor under the Truth in Lending Act.
