§2 Reforming subpoenas
This section prohibits administrative, grand jury, or trial subpoenas for bulk collection of subscriber information unless the governmental entity identifies the subscriber or customer by name, address, temporarily assigned network address, or account identifier. It bars use of such subpoenas to investigate, monitor, or retaliate against constitutionally protected speech, press, religion, assembly, or petition activities, and requires a perjury-certified attestation of legitimate purpose to the service provider and court. It permits service providers to notify customers or subscribers and consult counsel, except where limited by a nondisclosure order under section 2705(b). It requires each federal entity to publish annual public reports on the number of administrative subpoenas issued and accounts affected, disaggregated by statutory authority.
