H.R. 8838 — Congressional Prediction Market Ban Act of 2026

This section prohibits Members of Congress from engaging in, being a party to, or benefiting from covered transactions in prediction market contracts, which are agreements, contracts, swaps, or transactions dependent on the occurrence or extent of a specific event or contingency (as defined for excluded commodities under 7 U.S.C. 1a) other than lawful insurance. It extends the prohibition to household members whose transactions result in payments or benefits to the household, requires annual compliance certifications filed with the Clerk of the House or Secretary of the Senate within 15 days after the start of each calendar year, imposes fines of the greater of $10,000 or triple any profits from violations, and directs congressional ethics committees to investigate violations, establish procedures, issue guidance, and recommend additional sanctions.

This section directs congressional ethics committees to issue procedures and guidance within 90 days of enactment. It requires Members of Congress to comply with the new ethics requirements within 180 days of enactment.
