H.R. 8836 — Know Your American Customer Act

This section prohibits insured depository institutions and insured credit unions from opening or maintaining accounts for any covered individual not lawfully present in the United States. It requires such individuals to present one of 12 specified documents proving citizenship or lawful presence beginning 90 days after enactment, and directs temporary authorized-stay holders to provide expiration-date certification, after which institutions must allow 30 days of full access, restrict transactions for 60 days, and close the account if updated documentation is not provided.

This section imposes criminal penalties of up to $1,000,000 and 1 year imprisonment on individuals who are not lawfully present in the United States or subject to removal orders and who open or maintain active accounts at covered financial institutions. It provides exceptions for those whose authorized stay expired within the preceding 90 days or who have pending asylum applications, extends the penalties to use of legal entities, and clarifies that violations of related provisions do not independently trigger these penalties.
