“To prohibit troops at the polls, and for other purposes.”
No CRS summary available for this bill.
This section prohibits the use of federal troops at polling places by eliminating the exception permitting such force to repel armed enemies of the United States. It expands the list of federal crimes for which United States attorneys, marshals, and other officers must institute prosecutions to include sections 241, 242, 372, 592, 593, 752, 1071, 1581, 1583, and 1588 of title 18. It directs district courts to increase the number of magistrate judges to expedite arrests for these offenses and authorizes those judges to appoint persons who may summon the posse comitatus or land and naval forces to execute warrants. It creates a private right of action for injunctive relief against Senior Executive Service employees or political appointees in federal law enforcement agencies who violate section 592 of title 18, with direct appeal to the Supreme Court and expedited consideration by both courts.
