H.R. 10788 — Lower Premiums, Faster Payments Act

This section terminates the independent dispute resolution process for out-of-network emergency services and air ambulance services furnished on or after January 1, 2028 (from December 31, 2027). It sets the out-of-network rate to the qualifying payment amount for such services and revises the qualifying payment amount for 2028 to the median of 2019 contracted rates increased by cumulative CPI-U changes from 2019 through 2027, with subsequent years using the prior-year amount plus annual CPI-U.
