§2 Restriction on certain payments for compromise settlements or awards
This section requires any compromise settlement or award of $250,000 or more, or any nonmonetary relief, to a covered person to be litigated before a three-judge panel of the U.S. District Court for the District of Columbia, with appeals to the D.C. Circuit. Covered persons include the President, Vice President, cabinet members, certain Executive Office of the President employees paid at or above GS-15, political appointees, special government employees appointed by the President, their parents, spouses, and children, and affiliated entities. Any proposed settlement must be published in the Federal Register for at least 60 days of public comment, after which the court must find the settlement is not against the public interest and is not arbitrary, capricious, or otherwise unlawful before approving it.
