This section transfers authority to issue emergency orders under the Federal Power Act from the Federal Energy Regulatory Commission to the Secretary of Energy. It requires the Secretary to explain how each order best meets the emergency and serves the public interest, to specify the hours or methodology justifying its duration, to conduct a robust study of alternatives before renewing or reissuing any order lasting more than 96 hours, and to allow judicial review of renewed orders without prior rehearing. The section also bars orders that prevent retirement of generation facilities or require operation of retired facilities, except when no alternative meets the emergency and the relevant transmission organization requests the delay. It mandates Commission reports on costs and impacts within 30 days and utility notifications to customers within 60 days.
