This section prohibits the Department of Veterans Affairs from appointing or retaining health care employees under section 7401(1) or additional employees under section 7408 of title 38 if the individual has a criminal conviction for fraud, theft, embezzlement, bribery, kickbacks, false statements, or conspiracy involving federal funds, a final civil judgment under the False Claims Act (31 U.S.C. 3729–3731), or exclusion from federal health care programs under 42 U.S.C. 1320a–7. It requires advance notice and an internal grievance process, with attorney representation, for determinations based on knowing participation in schemes to misuse federal funds.
