“To establish certain requirements with respect to judicial actions challenging a State congressional redistricting plan, and for other purposes.”
No CRS summary available for this bill.
This section creates a private right of action allowing any aggrieved citizen to sue in federal district court within 30 days after a state enacts its final congressional redistricting plan. It vests exclusive jurisdiction in the district court for the judicial district containing the state capital, requires a three-judge panel for statewide claims with random selection of two additional judges from the state, mandates expedited consideration at the district court, circuit court, and Supreme Court levels, and limits appeals to a 10-day notice period. If a plan violates the Constitution or federal law, the court must first permit the state to propose a remedial plan before adopting its own replacement.
