H.R. 10249 — Kids Safety on Set Act of 2026

This section requires individuals participating in entertainment industry projects who have supervisory duties or frequent or private interaction with minors who are not their biological children or legal wards to pass a criminal background check within 90 days before their first day of work or receipt of ownership interest. The check must use Live Scan fingerprint clearance or an equivalent FBI screening limited to sex, violence, stalking, or minor-related offenses and cost no more than $100, paid by the entertainment entity.

This section authorizes the Attorney General to seek civil monetary penalties of up to twice the total production costs of all projects involving a violating employee against entertainment industry entities. It requires the Attorney General to seek an ex parte temporary restraining order halting all such project production activity, followed by a preliminary or permanent injunction that continues until the employee is no longer in violation or is terminated with no more than a 2 percent beneficial ownership interest and all special investor rights permanently revoked.

This section defines terms used in the Act, including compulsory authority as authority to compel a minor to act; employee as any individual signing a waiver or nondisclosure agreement with an entertainment industry entity; entertainment industry entity as a producer or distributor of entertainment works such as motion pictures, television, and streaming content but excluding journalism and Creative Commons releases; minor as a person under 18 years of age; supervisory duties as oversight of minors other than biological children or legal wards; and entertainment industry project as a discrete collaborative enterprise to create such works.
